SC to scrutinise police records in Samsung case

NEW DELHI: The Supreme Court on Monday called to scrutinise the Delhi Police records of a case lodged by Samsung Electronic­s Company against the man who, the company alleged, filed a false cheating case before a Ghaziabad court that led to the summoning of its chairman, Lee-Kun-Hee.

A bench headed by justice PC Ghose issued the order after the company’s counsel informed the top court that the police had made crucial headway into the case registered at its behest. The counsel also alleged that the probe details will reveal how fraud was played upon courts to take note of a fake complaint against the company.

Samsung’s counsel Gopal Subramaniu­m informed the bench that subsequent to the court’s last order case files from the trial court and Alalhabad high court had been produced before it. The court will hear the matter next on December 4.

The top court had last year stayed the non-bailable arrest warrant against Hee, South Korea’s richest man, but asked him to mark his presence before the Ghaziabad court.

Samsung had lodged a complaint with the Delhi Police, which after registerin­g an FIR conducted a detailed inquiry into the allegation­s. The police traced the person under whose name the case was registered against Hee to Tanjore district in Tamil Nadu and learnt he had never visited Ghaziabad. But, in his statement to the police, the man admitted to have signed documents at the instance of his former employer with whom he worked in Dubai as a driver.

Saumsung moved the Allahabad HC for quashing of the criminal case. The HC ordered a magisteria­l inquiry. The report is now with the SC in a sealed cover. HTC
