Court asks police chief to act against DCP

THE COURT MADE THE REMARKS WHILE HEARING A RAPE CASE AGAINST FOUR MEN

A city court has directed the Delhi Police commission­er to take action against two senior police officers including the deputy commission­er of police (North) for negligence and not following the proper proceeding­s while enquiring into a rape case.

The court made the remarks while hearing a rape case against four men at north Delhi’s Timarpur police station in 2016.

Observing that the “officer of higher level also does not know how to conduct the enquiry”, the court has directed the police commission­er to initiate proper action against the DCP and assistant commission­er of police (ACP) concerned.

“Despite opportunit­y given by this court, DCP has failed to take due course of enquiry. Hence, I am not satisfied with the report of the concerned DCP,” the court said, while noting that due to such negligence, matters are being delayed.

The court had earlier issued summons to the investigat­ing officer (IO) of the rape case which got misplaced by the police. On the next date of hearing, police officials said they have not received it and probably were not issued by court.

On checking of the court records, it came out that summons were issued to the IO. The court directed the DCP to conduct an inquiry and when it received the enquiry report, it noted that the enquiry has not been done in a proper manner.

“He has just enquired from a constable and assistant sub inspector and did nothing else,” the court noted.

It directed a copy of the order be sent to the commission­er for necessary action.
