Ggm school murder: CBI seeks two months for additional chargesheet
Gurugram: The Central Bureau of Investigation (CBI) on Tuesday sought two more months to file a supplementary chargesheet over the role of Gurugram police and the school management in connection with the murder of a Class 2 student at a private school in September 2017. The CBI assured the court that the probe was at an advanced stage and the supplementary charge sheet will be filed before the stipulated period if the probe gets over.
Seeking more time to wrap up investigation, the CBI submitted an application before additional sessions judge JS Kundu. On February 5 the agency had filed a chargesheet under Section 302 of IPC which mentioned that further probe under section of 173(8) of CRPC against the role of school management shall be submitted.
Tuesday’s proceedings in the case lasted five hours during which the additional sessions judge also heard arguments of the defence counsel Tanveer Ahmed Mir on four applications filed by the father of the accused.
On the application against treating the juvenile accused as an adult, Mir argued that the principal magistrate of juvenile justice board had not shared expert reports. “The reports should be supplied to us and if required, they are tested and rebutted, in order to have a proper assessment under section 15 of the Act,” Mir said. He also stated that the order to treat juvenile accused as an adult had been taken in a hurry.
The two other applications on which Mir presented his arguments were related to CBI being given the custody of the juvenile accused and collection of fingerprints at the crime scene. Mir said that the CBI had taken fingerprints of the juvenile after recreating crime scene.
“We have pressed upon that they were not given any opportunity to rebut the reports etc as an order cannot be passed without giving any opportunity to the juvenile,” said Sandeep Aneja, counsel of the juvenile accused.
A Class 2 student was found with his throat slit inside the school’s toilet on September 8, 2017. Although initially, the school’s bus conductor was arrested by the Gurgaon police in connection with the case, the CBI apprehended the 16-year-old student of the same school after taking over the probe. The conductor was acquitted later.
The custody of j uvenile accused in the murder case was extended till May 14. Prosecution and complainant will present their arguments on April 13.
