39-yr-old man booked for bursting ‘old, banned’ crackers in Ghazipur
NEW DELHI: The Delhi Police have booked an east Delhi resident for allegedly bursting firecrackers outside his neighbour’s door on Thursday evening.
The man was booked for defying found in violation of Supreme Court orders which had earlier stated that only ‘green crackers’ can be burst between 8pm and 10pm on Diwali.
A senior police officer said this could be the first case in Delhi where an FIR had been registered for bursting fire crackers. Hindustan Times, however, could not independently confirm it.
Pankaj Singh, deputy commissioner of police (east), said that the man, identified as Daman Deep, was booked under Indian Penal Code section 188 (disobedience to order duly promulgated by public servant), but not arrested.
“Deep has told us that he was bursting leftover firecrackers from last year. So, he was bursting banned fire crackers. Also, he was defying the Supreme Court orders by bursting crackers at a time when there was no occasion (such as Diwali or wedding),” said the DCP.
Reacting to the case, the Delhi Police said that more legal action is expected in the coming days.
“Anyone found violating the court orders will be booked under IPC section 188,” said Delhi Police spokesperson Madhur Verma.
Any person convicted under section 188 can be jailed for 30 days or fined ₹200 or both.
The case was registered on the complaint of 39-year-old Deen Bandhu, who lives with his family in an apartment in east Delhi’s Ghazipur and works with a private firm in Greater Noida.
According to Bandhu, problems began when his neighbour Daman Deep’s children began bursting crackers outside his apartment on Thursday evening.
“I asked them to stop the fireworks, but they didn’t listen to me. When their father arrived at 8.30pm, he too began bursting firecrackers on the stairs outside my door. When I asked him to stop again, he argued with me and said he would burst crackers at that spot only,” alleged Bandhu.
Bandhu then decided to call the police who arrived at the spot to find the remains of burst firecrackers on the stairs. “The leftovers of the burst firecrackers were collected in sealed packets for forensic examination to know if they were ‘green crackers’,” said the DCP.
