Order sheet not necessary in every case seeking expeditious disposal: HC
THE BENCH SAID IT IS ALWAYS OPEN FOR THE COURT TO DIRECT PARTIES TO PLACE ON RECORD COPIES OF THE ORDER SHEETS
PRAYAGRAJ: The division bench of the Allahabad High Court on Wednesday set aside an order of the single judge bench which directed the office of the high court to necessitate for order sheet in all such matters where prayer for direction for expeditious disposal is made before the authorities.
The division bench comprising Chief Justice Govind Mathur and Justice Piyush Agrawal held that nowhere the rules prescribes for filing the order sheets in each and every case where a direction is sought for expeditious disposal of a case pending before subordinate court.
“Hence, a direction given for filing the order sheets in each and every case where a direction is sought for expeditious disposal of any matter is running contrary or is demanding something which is otherwise not prescribed under the rules,” the court added.
The order sheets are a date wise compilation of orders made by a judge during the course of the hearing/disposal of a case.
The division bench made it clear that it is always open for the court to direct the parties concerned to place on record copies of the order sheets in any specific case, if the court considers it appropriate to have them.
The bench was hearing a special appeal filed by the ‘High Court of Judicature at Allahabad’ through its Registrar General to set aside the order dated December 3, 2020, of the single judge of this court.
The division bench, headed by the chief justice, especially sat on Wednesday, during the on-going winter vacation, to decide this important matter which pertains to filing of various cases in the high court.
