Lawyer accused of attacking cop gets interim relief
PRAYAGRAJ : The Allahabad high court on Tuesday granted interim anticipatory bail to one Arpit Bisht, an advocate enrolled with Delhi Bar Council, who is accused of attacking a cop. The order was passed by justice Siddharth on the anticipatory bail application filed by Bisht.
The allegations in the FIR were that a few days back when a police officer went to ICICI Bank, Sector- 18, Noida, in connection with the investigation of a case, he was attacked by fivesix unknown persons and his pistol was snatched.
It was submitted on behalf of the applicant that the applicant was not named in the FIR. He is a practising lawyer enrolled with Delhi Bar Council.
He went to the spot of the incident only on receiving the phone call of one Sarthak Tyagi, who is his friend and after the situation got out of control, he left the place in a car with his friend. He had no role in the incident and was falsely implicated in the case.
An FIR was registered under Section 395 (dacoity) of Indian Penal Code at Noida Sector-20 police station of Gautam Buddh Nagar. According to the petitioner, he had apprehension that he may be arrested by police any time and his house was raided earlier by a police team.
The court, while granting the state government three weeks’ time to file a counter affidavit (reply) in the case, fixed January 21 as the next date of hearing. However, the court said the investigating officer will continue with the investigation of the case and will not be affected by the order.
