HC dismisses petition of married woman in live-in relationsh­ip

PRAYAGRAJ: The Allahabad high court on Monday dismissed a petition of a married woman in a live-in relationsh­ip, seeking protection from her husband.

The bench comprising Justice Sunita Agarwal and Justice Sadhna Rani refused to grant any protection to one Surabhi who had alleged in the petition that she left her matrimonia­l home because of the “antisocial activities of her husband.”

According to the petitioner, she left her husband’s house as he used to harass her. Later, she started living with her live-in partner, Mohit.

In the petition, it was stated that the petitioner had also moved an applicatio­n before the chairman, Human Rights Commission, New Delhi, seeking protection from her husband. The high court, after hearing the petitioner’s counsel and government advocate, observed, “However, it is an admitted fact of the matter that the petitioner has not moved any applicatio­n under relevant provisions such as Domestic Violence Act and Indian Penal Code, for any threat or act of violence of her husband.

“It is an admitted fact of the matter that the petitioner has not even filed any petition under the Hindu Marriage Act for divorce.

“In view of the said admitted fact, the vague plea in the writ petition that respondent No. 4, husband of the petitioner, is harassing her, cannot be entertaine­d.

“The writ petition is, thus, devoid of merit and is dismissed,” added the bench while rejecting the plea of the petitioner.
