‘Agreements to lease parking lots, toll contract to be taxed’
Revenue dept says govt is liable to get stamp duty on settled amount
CHANDIGARH: The Haryana government has ordered that any agreement or contract to lease a parking place and toll is chargeable for payment of stamp duty.
The revenue department in a March 27 communication said that it had been noticed by the state government that agreements of parking or toll contracts were being executed by the parties without proper stamp duty imposed under the Indian Stamp Act, thereby causing a loss of stamp duty and registration fee to the state government.
Agreement to lease parking lots and toll contracts were covered under the description of lease under the Indian Stamp Act and were chargeable to duty. Thus, the state government is liable to get stamp duty on the settled amount from the contractors to whom the parking lots and tolls have been allotted, the revenue department said.
In fact, Haryana chief information commissioner (CIC) Yashpal Singal had pointed out this aberration after examining a Right to Information (RTI) appeal in this regard. Singal also directed the additional chief secretary, revenue, to look into the matter and issue instructions to the registration authorities for its compliance.
“It is clarified that an agreement to lease parking places and other toll contracts were covered under the scope of term lease. If the lease is from year to year or for any term exceeding one year or reserving a yearly rent, it is compulsory to register it under the Registration Act, 1908,” the revenue department said
