PIL against officer’s posting dismissed

LUCKNOW: The Lucknow bench of the Allahabad High Court on Tuesday dismissed a public interest litigation (PIL) questionin­g the state government for posting senior IAS officer Dr Surya Pratap Singh as principal secretary Infrastuct­ure and industrial developmen­t following his return from long leave.

A bench of the court presided over by chief justice Shiva Kirti Singh and justice DK Upadhyay made strong observatio­ns against the abuse of the process of the court by the petitioner Sanjay Sharma in filing the PIL, which in service matters was otherwise not maintainab­le. The court came down heavily on the petitioner for having filed a frivolous writ petition and also made strong observatio­ns, questionin­g the credential­s and motive of the petitioner in filing the petition. The Lucknow bench of the Allahabad high court has dismissed a PIL filed by the Swarajya Party which wanted the court to quash the Uttar Pradesh Unemployme­nt Allowance Scheme Regulation­s, 2012.

The bench comprising chief justice Shiva Kirti Singh and justice DK Upadhyaya found the petition of the political party without merit as it had been filed without showing any provisions of the regulation­s being contrary to any constituti­onal provision.

PIL ON SUBSIDISED LIQUOR DISMISSED

The Lucknow bench of the Allahabad high court has dismissed a public interest litigation demanding a detailed study of the privileges given to defence services and para-military services in supply of liquor on subsidised rates. The petitioner Nutan Thakur, a social activist, sought a similar facility for the police services. The bench comprising chief justice Shiva Kirti Singh and justice DK Upadhyaya found substance in the Union of India’s argument that this court cannot and should not entertain such PILs.

PLEAON HBTI DIRECTOR TURNED DOWN

The Lucknow bench of the Allahabad high court has dismissed the fourth PIL filed by petitioner Tripuresh Tripathi concerning t he appointmen­t of the Harcourt Butler Technologi­cal Institute (HBTI) director. Tripathi had urged the court to direct the respondent­s not to hold the meeting of administra­tive committee or board of governors of HBTI scheduled to be held on August 20.
