Cops yet to receive court order against Mulayam

LUCKNOW: The city police, which has been reluctant to register a case against Samajwadi Party (SP) chief Mulayam Singh Yadav, on Thursday stated that they had yet not received the court order directing it to lodge an FIR against the veteran politician for allegedly threatenin­g inspector general (IG)-rank IPS officer Amitabh Thakur over the phone.

On Wednesday, the court of chief judicial magistrate Som Prabha Mishra had directed the city police to lodge an FIR against Yadav for allegedly threatenin­g Thakur over the phone on July 10.

The court had asked the police to probe the matter properly and also apprise the court about the findings.

SSP Rajesh Pandey said the compliance of the court’s direction would be done once they received the order’s copy.

Thakur had moved the court after the police showed reluctance to register the FIR against Mulayam and had rejected his applicatio­n.

The court, however, accepted Thakur’s applicatio­n under Section 156(3) of the Criminal Procedure Code, directing Hazratganj station house officer Vijay Mal Yadav to file the FIR under relevant sections and probe the matter. Section 156(3) of the CrPC empowers a magistrate to direct the police to file an FIR.

The court observed that after going through the facts provided by Thakur, it appeared to be a case under Section 506 of the Indian Penal Code (punishment for criminal intimidati­on).

The court said while report of the SHO, Hazratganj, stated that the applicatio­n was moved for gaining publicity, it did not say anything on the FIR – whether it was registered or not.
