HC DISMISSES KOHLI BLOOD BANK’S PLEA
The Lucknow bench of Allahabad high court has dismissed a writ petition seeking quashing of an FIR against Kohli blood bank.
In the FIR registered with Chowk police station, t he blood bank has been accused of luring minors to sell their blood and forging documents to show the minors had not donated blood.
A division bench of justices Ajai Lamba and Aditya Nath Mittal dismissed the writ petition filed by Kohli Blood Bank and Components Pvt Ltd.
The petition sought the court’s direction to quash the FIR lodged on August 7, 2015 by Lucknow drug inspector after a raid at the blood bank in Chowk.
“The investigating agency, on the basis of evidence collected in the course of investigation, has concluded that the offence has been committed.
The counter affidavits refer to various materials on the basis of which, the said conclusion has been drawn. This court in extraordinary writ jurisdiction will not substitute its own opinion with the opinion of the investigating officer.
Be that as it may, in extraordinary writ jurisdiction, we are unable to record, in peculiar facts and circumstances of the case, that the offence has not been committed. Petition is dismissed,” the court ordered.
