Ensure no encroachments in parks: HC
The Lucknow bench of the Allahabad high court has observed that the Lucknow municipal commissioner is under obligation to ensure that encroachments do not take place in parks.
With this observation, the court disposed of a writ petition and asked the municipal commissioner to look into the matter, ascertain the correct factual position and take such remedial measures as are required in law after giving an opportunity to the persons concerned, if any, to put forth their version expeditiously.
A division bench of chief justice Dr DY Chandrachud and justice Rajan Roy gave this judgement on a public interest litigation (PIL) petition pending since 2012, seeking a direction for maintenance of a park situated in Viram Khand-ll, Gomatinagar. The petition raised the issue of alleged encroachment in this park. It also sought direction for demolition of two residential rooms and bathroom constructed there.
