Ensure no encroachme­nts in parks: HC

The Lucknow bench of the Allahabad high court has observed that the Lucknow municipal commission­er is under obligation to ensure that encroachme­nts do not take place in parks.

With this observatio­n, the court disposed of a writ petition and asked the municipal commission­er to look into the matter, ascertain the correct factual position and take such remedial measures as are required in law after giving an opportunit­y to the persons concerned, if any, to put forth their version expeditiou­sly.

A division bench of chief justice Dr DY Chandrachu­d and justice Rajan Roy gave this judgement on a public interest litigation (PIL) petition pending since 2012, seeking a direction for maintenanc­e of a park situated in Viram Khand-ll, Gomatinaga­r. The petition raised the issue of alleged encroachme­nt in this park. It also sought direction for demolition of two residentia­l rooms and bathroom constructe­d there.
