Bareilly teenager rape case: Court refuses DNA test

BAREILLY: A fast track court of Bareilly refused permission for DNA examinatio­n of the child of the teenage rape victim after terming it ‘not maintainab­le’ on Thursday. The appeal for DNA examinatio­n was made by the counsel of the accused. The girl’s counsel appealed against it terming it a ‘delaying tactic.’

The accused side wanted to divert the focus of the court from the rape case by using the appeal for DNA examinatio­n,” said VP Dhyani, counsel of the girl.

Meanwhile, the counsel of the accused has decided to challenge the order in the high court. “The DNA test is the best way to clear the case. I see no reason why the girl’s counsel is stalling it. We will challenge the order in Allahabad high court,” said Anil Kumar Bhatnagar, counsel of the accused.

The court has further summoned the girl to record her statements on next hearing on May 3. The 14-year-old victim delivered the baby in October last year after she was denied permission for MTP.

To recall, the girl was repeatedly raped by her neighbour on the pretext of marriage. The accused abandoned her once she conceived.

The girl and a family applied for medical terminatio­n of pregnancy (MTP) which was refused by local courts in Bareilly. The family then approached Allahabad high court.

The court directed chief medical officer of Bareilly to set up a medical panel and decide on the possibilit­y of MTP.

Almost three months after the girl applied for MTP the medical board denied permission and the girl had to give birth to the child. The girl continue to live with her four- month-old child at her parent’s home in Bairamnaga­r.

The accused was initially send to prison in the rape case but is currently out on bail.
