SIGNIFICANT PROVISIONS

CRIMINAL LAW (AMENDMENT) ORDINANCE, 2018

▪ Minimum punishment for rape increased to 10 years’ rigorous imprisonment, extendable to life ▪ Minimum punishment for rape of a girl under 16 increased to 20 years, extendable to imprisonment for rest of life

▪ Punishment for rape of a girl under 12 is minimum 20 years’ imprisonment, or imprisonment for rest of life, or death

▪ Investigations have to be completed in 2 months. Trials have to be completed in 2 months and appeals in 6 months

▪ NCRB to maintain a national database of sex offenders

▪ No provision for anticipatory bail in the case of rape of a girl under 16 years of age

FUGITIVE ECONOMIC OFFENDERS ORDINANCE, 2018

▪ Provision for an application before a special court for declaration of an individual as a

fugitive economic offender ▪ Attachment of the property

of a fugitive economic offender and proceeds of crime

▪ Issuing of a notice by the special court to the individual alleged to be a fugitive economic offender

▪ Confiscation of property of

an individual declared as a fugitive economic offender or even the proceeds of crime

▪ Disentitlement of the fugitive economic offender from defending any civil claim ▪ Appointment of an administrator to manage and dispose of the confiscated property
