HC up­holds move to give addl marks for higher qual­i­fi­ca­tion

The Pun­jab and Haryana high court on Fri­day up­held the Haryana gov­ern­ment’s de­ci­sion to grant ad­di­tional marks to per­sons with higher qual­i­fi­ca­tion and those with no fam­ily mem­bers in gov­ern­ment ser­vice, dur­ing re­cruit­ment of con­sta­bles in Haryana po­lice.

Dis­miss­ing a batch of pe­ti­tions against the gov­ern­ment’s de­ci­sion, the high court bench of jus­tice AB Chaud­hari and jus­tice HS Madaan re­fer­ring to a pro­vi­sion on grant­ing ad­di­tional marks to those with no one in gov­ern­ment em­ploy­ment said that such a pro­vi­sion is praise­wor­thy as no state in the coun­try has made such a pro­vi­sion or recog­nised the un­for­tu­nate de­pri­va­tion of not hav­ing em­ploy­ment in gov­ern­ment de­part­ments.

The court was hear­ing a batch of ap­peals against ad­di­tional marks be­ing given to post grad­u­ates, those with no one from fam­ily in gov­ern­ment jobs and ad­di­tional marks for can­di­dates from de-no­ti­fied no­madic tribe for the re­cruit­ment of con­sta­bles in Haryana po­lice.

“This would cer­tainly be help­ful to the gov­ern­ment be­cause of the higher ed­u­ca­tion lev­els of po­lice con­sta­bles. It would ben­e­fit the state and pub­lic at large,” the court said on ad­di­tional marks to those with higher qual­i­fi­ca­tions.

It is a known fact that a ma­jor reser­va­tion goes to other re­served cat­e­gories as against de­no­ti­fied tribe (Vimukt Jatis and Tapri­was Jatis) or no­madic tribes.

This class of tribe hardly have any rep­re­sen­ta­tion in the gov­ern­ment em­ploy­ment, the court said on ad­di­tional marks to can­di­dates of no­madic tribe.
