Lalu doesn’t deserve bail as he is yet to complete half of his jail term: CBI

RANCHI: The Central Bureau of Investigat­ion (CBI) contended that incarcerat­ed Rashtriya Janata Dal (RJD) chief Lalu Prasad didn’t deserve bail as he is yet to complete half of the 14year jail term awarded to him in a fodder scam case.

The CBI on Friday furnished its reply in response to the bail petition filed by Prasad in the Jharkhand high court last month.

The special CBI court in Ranchi on March 19, 2018, had held Prasad guilty under conspiracy and corruption charges in the fodder scam case related to fraudulent withdrawal of Rs 3.76 crore from Dumka treasury during December, 1995, to January, 1996. It had handed him 14 years in prison and slapped a fine of Rs 60 lakh on him.

Prasad applied for bail in this case on medical grounds. The former Bihar chief minister has been undergoing treatment in custody for the last 19 months. He is currently admitted at the Rajendra Institute of Medical Sciences (RIMS), Ranchi. The CBI said Lalu is doing well on health issues

The CBI, after seeking court’s permission, on Friday filed a counter affidavit to oppose

Prasad’s bail plea. “We have submitted that Prasad was yet to complete half of 14-year sentence awarded to him by the lower court. He has completed only 22 months in prison. Moreover, there is no fresh complaint regarding his health issues. In fact, he is doing well on health front in comparison to his last medical report,” said assistant solicitor general Rajiv Sinha, representi­ng the CBI.

The bench of Justice Aparesh Kumar Singh fixed November 22 to hear the contention­s of both the parties.

Prasad has so far been convicted in four separate fodder scam cases and sentenced to different terms of imprisonme­nt. He has already secured bail in two cases and currently facing trial in the fifth and last case in Jharkhand.
