HC stays coercive action against MP Nishikant Dubey

A resident of Deoghar district lodged an FIR last year, alleging that Dubey’s MBA degree was fake and fabricated

RANCHI: The Jharkhand high court on Wednesday restrained the police from taking any coercive measures against BJP’s Godda parliament­arian Nishikant Dubey in the light of an FIR lodged against him allegedly for holding fake MBA degree of Delhi University.

The court’s order came in response to a petition filed by Dubey seeking judicial order to quash the aforesaid FIR.

The bench of justice Ananda Sen directed the police not to take any coercive measures against Dubey till further orders and also issued notice to the complainan­t Vishnu Kant Jha.

Jha, a resident of Deoghar district, lodged the FIR with Deoghar town police station last year alleging that Dubey’s MBA degree was fake and fabricated.

He said that the Delhi University, under a reply to right to informatio­n (RTI), had denied to have issued any such certificat­e in the name of Nishikant Dubey.

Jha has also charged that during Lok Sabha elections, Dubey had used this fake certificat­e to cheat voters and submitted wrong informatio­n in

this regard to the election commission of India.

The FIR against the lawmaker was registered under Sections 468 (forgery for purpose of cheating) and 420 (cheating) of the Indian Penal Code (IPC).

Dubey, however, rubbished the allegation. He argued that he had never used any fake degree certificat­e for any purpose. He said that it was the ECI which should decide the matter or take action against him if he had furnished a wrong informatio­n to the commission.

In yet another matter, the Jharkhand high court sought the state government’s reply in response to Dubey’s wife Anamika Gautam’s petition challengin­g the proceeding­s initiated by Deoghar deputy commission­er for cancellati­on of land sale deed owned by her.

The matter is related with an FIR lodged by Vishnukant Jha on July 13 last year against Dubey’s wife Anamika Gautam and others allegedly for conspiring with government officials to purchase a property worth Rs 20 crore at an undervalue­d rate of Rs 3 crore.

Following this, Deoghar DC has initiated a proceeding for “sale deed” cancellati­on.

Aggrieved by DC’s move, Gautam moved high court stating that the DC has no power to initiate such proceeding­s against her.

On Wednesday, state lawyer informed the high court that the DC, after completion of the proceeding­s, had passed final orders.

The DC, early this week, had cancelled the land sale deed and ordered the concerned authority to lodged FIR against the buyer, seller and others involved in the said murky land deal.
