Jammu and Kashmir police on Wednesday informed the district court that the woman who was detained along with Major Leetul Gogoi had gone with the officer out of her own volition. The investigation report submitted by the police also confirmed that the girl is 19-years-old.
Police also informed the court that neither woman nor hotel owner lodged any formal complaint against the army Major.
In a report submitted by station house officer, Khanyar, in the court of chief judicial magistrate (CJM) Srinagar, the police informed that woman in her statement recorded before magistrate said she had gone with the army Major out of her own choice and there was no pressure on her.
The CJM on Saturday had sought status report of the investigation of hotel fracas involving Major Gogoi after human rights activist Ahsan Untoo filed a petition.
Police submitted school records of the woman in the report to confirm her age.
Police mentioned in the report that woman told the magistrate that she had befriended the army Major on Facebook and it was a month ago when she had learnt that he (Gogoi) was in the army.
The woman had also told the magistrate that she spoke to Sameer Malla and Major Gogoi over the phone and met them at Magam on the day police detained them after they got in an altercation at the hotel.
Police in its report said that girl told the magistrate that she decided to travel with the officer of her own volition. The police report said the girl was handed over to his maternal uncle, and Major Gogoi and Sameer Malla were handed over to their unit.
Last week, army chief General Bipin Rawat had promised “exemplary punishment” for Major Gogoi if he was found guilty of violating rules. The army has already ordered a court of inquiry against the officer.
Last April, during by-elections for the Srinagar Lok Sabha seat, Major Gogoi had tied a civilian Farooq Ahmad Dar to the bonnet of his jeep as a human shield to deter stone-pelters from allegedly targeting his troops. The incident led to a human rights controversy. General Rawat later awarded Gogoi a commendation card for his “sustained efforts” on counterinsurgency operations.
