Creamy layer income limit to be hiked to ₹8 lakh

The creamy layer ceiling for OBC and SBC reservatio­n will be increased to ₹ 8 lakh from the existing ₹ 2.5 lakh per year. Energy Minister BD Kalla said the Union government Sep 13, 2017 had increased the limit to ₹8 lakh, on the same lines the Rajasthan government will also increase the limit to ₹ 8 lakh.

It is a serious issue and all the parties want to resolve it and give 5% reservatio­n to the community. Why again and again we are misguiding them.

by Justice Sunil Kumar Garg, and the State Backward Classes Commission have recommende­d that five castes – Gujar/ Gurjar, Banjara/baldiya/labana, Gadiya Lohar/ Gadoloiya, Raika/ Rebari/ Debasi, Gadariya/ Gadri/ Gayari – should be categorize­d as more backward classes.

He said that the State Back- ward Classes Commission has unequivoca­lly concluded in its reports that special circumstan­ces envisaged in the Indra Sawhny’s case do exist in the state and there are reasonable grounds to exceed the limit of 50% to ensure adequate representa­tion of backward classes in admissions and appointmen­ts.

Shobhit Tiwari, who challenged the 2017 law hiking OBC reservatio­n to 26%, said the new bill is a contempt of court. “I will advise my clients – Dr Gurvinder Singh and Samata Andolan – to move a contempt petition in the Rajasthan high court,” he said.

Former high court judge Justice Pana Chand Jain said the new law will also fall flat in judiciary. “The 50% ceiling for reservatio­n is almost like a Constituti­onal provision and any attempt to change that, even by putting the law in the Ninth Schedule, will not be validated,” he said.

Gujjar leader Vijay Bainsla said he had not received any informatio­n about the bill from the government. “Col (Kirori Singh) Bainsla has requested experts from the communitie­s included in the bill to study the new law so that this time it is legally foolproof,” he said. He did not say anything on calling off the agitation.
