Initiate action against ‘fake rape’ cases: DGP

JAIPUR: The Rajasthan police will take action against people registerin­g fake rape complaints and launch an awareness drive to convey the message that the law is equally strict against fake complainan­ts as well.

Director General of Police (DGP) Bhupendra Singh said that seeing the high number of closure reports in rape cases in the state, the superinten­dents of police (SPS) and deputy commission­ers of police (DCPS) have been directed to review the reasons behind f i l i ng t he f i nal report (FR).

“In a meeting held few days back, a decision was taken to start a drive against those registerin­g fake cases under section 211 and 182 of Indian Penal Code (IPC) so that a message is conveyed that the law is equally strict for them too. The DCPS and SPS have been also directed to extensivel­y promote the drive,” said Singh.

The state police chief further said that action would be taken against people who lodged rape cases when the crime did not take place. “There are two types of FRS – one, in cases where the crime did not take place; and two, in which crime could not be proven during investigat­ion. Action would be taken against people who register the first category of cases,” the DGP said.

He added that a case under section 211 of IPC is registered against people who falsely charge any person with having committed an offence, knowing that there is no just or lawful ground for such proceeding or charge against that person. In 2019 (until October), FR was filed in 43.31% of rape cases because police found that the crime did not occur. In 2018, the number was 43.03%.

In an affidavit filed in Rajasthan High Court in May last year, t he s t at e government s ai d according to Rajasthan Police, 43% of rape cases in 2018 turned out to be false during investigat­ion. According to legal expert Bhanwar Singh Chouhan, a rape case is called false case if there are discrepanc­ies in any of the three – circumstan­tial evidence, witnesses or biological evidences.
