Man gets life term for 18-year-old’s murder

COURT ALSO SLAPPED THE CONVICT WITH A PENALTY OF ₹75,000 FOR THE MURDER

KOTA (RAJASTHAN): A special court in Bundi on Friday sentenced a man to life imprisonme­nt for murder of an 18-yearold woman over eight years ago.

The Protection of Children from Sexual Offences (POCSO) Act court also slapped the 30-year-old convict with a penalty of ₹75,000 for the murder in Bundi City in February 2014.

The POCSO court–II judge, Balkrishan Mishra, held Shamsher Suman, resident of Devpura area of the city, guilty under IPC sections 302 (murder) and 201 (causing disappeara­nce of evidence) and sentenced him to seven years imprisonme­nt under respective sections, Public Prosecutor (PP), POCSO court – II, Mahaveer Meghwal said.

The woman’s father lodged a missing report at Bundi City police station on February 5, 2014, stating that she had left home for coaching on February 3 and did not return home, he said.At least nine days later, the woman’s body was recovered from a well near Bundi Railway Station, he said.

Police registered a case of murder and rape under IPC sections 366, 376, 302 and 201 against unidentifi­ed person and initiated the investigat­ion, the public prosector said.

The investigat­ion found that Suman lured the woman and took her with him on February 3, 2014 and allegedly raped her, strangled her to death and dumped the body into the well near railway station, he said.

The police arrested the accused and filed the charge sheet in POCSO court after completion of investigat­ion into the matter. The accused, however, was released from jail on bail, Meghwal said.

While the court convicted Suman for the murder of the woman, the charge of rape was not proved, according to the public prosecutor. Statements of at least 29 witnesses were recorded during the trial, he said.

As per the court’s orders, the survey is expected to take three-four days, during which the entire process will also be video graphed and photograph­ed. The court also ordered that both basements of the mosque will also be surveyed.

The timing of the survey is significan­t as it commenced on Friday when Muslims offer prayers once a week at mosques.

The petitioner­s, Rakhi Singh, Laxmi Devi, Sita Sahu, and others filed the case, demanding permission for daily worship and performing rituals at Shringar Gauri, Lord Ganesha, Lord Hanuman and Nandi located on the outer wall of the Gyanvapi mosque. The civil court April 8 appointed Kumar as the advocate commission­er in the case, and asked to present a report at the next hearing on May 10.

The petitioner­s’ advocate and his assistant, and advocates of the two parties in the case would remain present during the inspection, said the petitioner­s’ advocate Madan Mohan Yadav. Police force should also be made available during the survey, if required, the court had said. SM Yasin, joint secretary of the Anjuman Intzamia Masajid Committee, earlier announced to oppose the survey and videograph­y at the Complex. However, the Committee’s lawyers said they will obey the law, but if any such thing takes place which is not as per rule, they will complain. The Kashi Vishwanath Temple and the Gyanvapi mosque — built by Mughal emperor Aurangzeb — have been a lingering dispute involving the two shrines. The petitioner­s representi­ng the Temple sought the declaratio­n that the mosque stands on land belonging to Hindus. The Anjuman Intezamia Masjid on the other hand opposed the petition.
