COUNTDOWN TO THE DEMOLITION

built plans for 90 flats and 40 shops in the society and Trimurti Builders and Developers was given the contract to sell 40 shops. The shops were purchased for Rs10 lakh each
IN 2011,
the society filed a writ petition alleging that the shops were illegal and sought its demolition.
FOLLOWING THIS,
the high court directed Navi Mumbai Municipal Corporation (NMMC) to examine issue and take action as per law in respect of illegal structure. NMMC submitted that the society had carried out illegal constructions in 100 flats
ON AUGUST 29, 2011,
an order confirmed by the civic body confirmed that the society had carried illegal construction in its flats and that they needed to be demolished
THE SOCIETY’S PLEA
to the HC and then to the urban development department were both dismissed
IN 2012,
the society filed a writ petition which was dismissed. Following this a Special Leave Petition was also filed in the SC, which, too, was dismissed
IN MARCH 2013,
shop owners claimed that despite three restraining orders from the HC and one from SC, members of the society had demolished 40 shops on the ground floor
IN APRIL,
the HC refused to accept the society’s contention that it had the right to demolish any area to reduce its FSI usage and refused to grant any ad-interim protection staying the demolition.
