Relief for Modi, BCCI’S SGM stayed
MUMBAI: In another setback for its president N Srinivasan, a Delhi court on Saturday restrained the BCCI from holding its Special General Body meeting in Chennai on September 25 that was set to ban former IPL commissioner, Lalit Modi, for life.
The court granted stay on a petition filed by Modi. The SGM was called to consider the disciplinary committee report on Modi’s alleged financial irregularities during his IPL tenure He was indicted by the Arun Jaitley, Chirayu Amin and Jyotiraditya Scindia on eight different charges.
The BCCI will challenge the order on Monday. Additional district judge, Ruby Alka Gupta, also issued a four-day notice to the Board for its response and posted the matter for September 30. Modi, in his plea, has challenged Sanjay Patel’s authority as BCCI secretary in issuing the notice to him for considering the disciplinary panel’s report. “The plaintiff (Modi) has prima facie shown the notice of the SGM has been issued without appropriate authority. He has also shown that he shall suffer irreparable loss terms of money, by the report of the disciplinary committee being considered in an unauthorised meeting,” said the ex-parte order
“The balance of convenience thus lies in favour of the plaintiff The defendants (BCCI, its office bearers and disciplinary commit tee) are thus hereby restrained from holding the SGM scheduled for September 25,” it said.
