COURT DIRECTS COMPANY TO PAY ₹2L OVERDUE TO EXEMPLOYEE

MUMBAI: Two years after a sales manager from Kandivli filed a civil suit against a company for not paying his three-month salary, the civil court ruled in his favour last week. The court ruled the man is entitled to recover ₹2.02 lakh from the company with an interest of 18%.

Gulab Khemani had joined a popular food and beverages manufactur­ing company in December 2014 and resigned from his post in July 2016. After the company did not respond to his letter where he demanded the due amount of ₹2.02 lakh for the months of May, June and July 2016, Khemani filed a civil suit against the company and its director in November 2016 . While Khemani presented his case before Judge JV Deshmukh, neither the company nor the directors filed any statements in their defence, the court noted.

In his submission, Khemani, through his advocate AV Mahadik, told the court that he had received the daily allowances of ₹7,000 for May but had not receive the salary for that month and the following two months. He also did not receive ₹60,000 that was the leave encashment amount. The court held that Khemani’s former employers have not contested the suit nor tendered any evidence in their defence. The court has also ruled that Khemani is entitled to receive his relieving letter and experience certificat­e along with the salary amount.
