Yeida official asked to pay ₹2.57 negligence penalty

GREATER NOIDA: The Yamuna Expressway Industrial Developmen­t Authority (Yeida) has imposed ₹2.57 lakh penalty on a manager rank official whose negligence caused a financial loss to the authority and also to an apartment buyer.

Homebuyer Sanjay Kishor bought a 2BHK apartment in a 2013 scheme floated by the Yeida. The size of the apartment was 99.86 square metres and in accordance with the Yeida scheme, an allottee can pay the flat cost in instalment­s.

The manager in question had in 2013 issued a payment plan to the buyer for a 1BHK apartment having a size of 54.75 square metres instead of a 2BHK flat that was allotted to him in a lucky draw. Subsequent­ly, buyer kept making payments as per the 1BHK apartment rate to the authority.

On May 26, 2017, the Yeida issued defaulter notice and also imposed a penal interest against allottee because his payments were not as per the cost of a 2BHK flat. On November 28, 2018, the apartment buyer filed a complaint with regard to the payment plan.

“Since it is not my error, why should I pay the penal interest against the defaulted amount as the negligence is on the part of the authority. I can only pay the remaining amount against the 2BHK apartment,” said Kishor, who was shocked to get the defaulter notice in 2017.

The Yeida offered him a waiver on the penal interest under a one time settlement scheme but he refused to the settle the accounts.

“Since the authority found no error on the part of the allottee, we decided to recover the penal interest amount of ₹2.57 lakh from the manager, whose negligence not only caused mental agony to our allottee but also unwarrante­d issues in the department. We will also initiate disciplina­ry action against the manager because this is a big mistake that has harmed the reputation of the authority,” said Arun Vir Singh, chief executive officer, Yeida.
