HC directs probe against doctor who helped accused get bail with fake medical certificates
NEW DELHI: The Delhi High Court on Tuesday directed the Delhi Police to conduct an inquiry into the allegations against a doctor for issuing fake medical certificates even after having his medical license suspended by the Delhi Medical Council. The high court also directed the Legal Cell of Delhi Police and the Directorate of Prosecution to examine their records and ascertain as to in how many cases accused or convicts applied for bail, interim bail and suspension of sentences in the last two years based on medical certificates and pathological reports issued by Dr Gajender Kumar Nayyar. The police, in its status report, referred to six cases where the accused sought bail on the pretext of illness of a family member and the medical reports in each case were issued by Dr Nayyar. However, on verification, it was found that misleading facts were placed before the courts. Millennium Post, on July 2, had reported this malpractice. "On May 8, 2020, one accused Abdul Rehman approached the High Court of Delhi for interim bail under the pretext that he needed to care for his ailing wife Rukhsar. He placed some medical certificates, provided by Dr Nayyar from NC Hospital in Dwarka as well as KS Nursing Home in Noida (UP). During the course of the inquiry, it was revealed that Dr Nayyar had issued fake medical certificates," police said. Further, the Delhi Police probe had revealed that the Delhi Medical Council had held the practice of Dr Nayyar to be highly unbecoming of a medical practitioner and had also struck his name from the State Medical Register for a period of 365 days till November 29 this year.
