Tuition sop not for grandkid

- Tax matters ■ Kamal Rathi

QI am a retired bank officer and my age is 69 years. All my assets are self- acquired. A court has declared me as guardian of my only minor grandson. I spend for his education and healthcare. So am I eligible to seek incometax exemptions? A. VENKATACHARY Via email

A) As per Section 80C, tuition fees paid for your children can be claimed as a deduction. So you are not allowed to claim deduction for this.

Deduction under Section 80DD can be claimed for money spent on maintenance including medical treatment of a dependant who is a person with disability. The amount of deduction varies depending on the severity of the disability. If the treatment for specified diseases mentioned in rule 11 DD ( 2), you can claim deduction for you or dependent under Section 80DDB.

QSBI CPPC Hyderabad, pension reviewing and processing authority, has overpaid my pension by ` 22 lakh from April 2005 to July 2017. Due to this, I had to pay an excess income- tax of ` 6 lakh. SBI says I can get the refund from IT department. ITO office, however, says there is no provision in income- tax rules to refund. Please advise. D. K. BHATTACHARYA Via email

A) There should be no problem in claiming refund if the tax is paid and e- TDS return to this effect is filed. The tax paid on your behalf will directly get reflected in your 26AS statement on the income- tax website. The credit of tax can be claimed after adjustment of taxes. The balance amount leftover after adjustment of the taxes can be claimed by you and the income- tax department is bound to refund you the amount, if the claim of refund is correctly adjusted.
