The Congress on Wednesday said that no final decision has been taken regarding the impeachment of Chief Justice of India Justice Dipak Mishra. General secretary of the CPI( M) Sitaram Yechury had said, “We are discussing with the Opposition parties on the possibility of an impeachment motion against the chief justice in the Budget Session.” In response to a question senior Congress leader Mr Kapil Sibal said, “It is a very delicate issue we will be talking to other parties too and then decide on our course of action.”

To move an impeachment motion the parties need to have signatures of fifty members of Parliament in either House. If the Congress agrees to it along with other Opposition parties, the Rajya Sabha can move an impeachment motion. Insiders claim that talks amongst the Opposition parties may start soon, however presently no final decision has been taken by the principal opposition party the Congress. Parliament is presently in session and will break for recess on February 9. Interestingly, the Congress welcomed the decision of CJI Dipak Misra on Tuesday who recommended the impeachment of Justice Shri Narayan Shukla, the eighth senior- most judge of the Allahabad HC, following an adverse report about him by an in- house panel set up by the CJI led by the Chief Justice of Madras HC Justice Indira Banerjee to probe into the matter.
