Withdrawal of gay plea allowed by SC
New Delhi: The Supreme Court on Monday allowed Naz Foundation to withdraw its the curative petition in the ‘ gay issue’ as it had become infructuous after the 2018 verdict quashing IPC Section 377 insofar as it recriminalises homosexuality between two consenting adults. A bench of CJI Ranjan Gogoi and Sanjeev Khanna allowed the petition filed in 2014 against the December 2013 verdict to be withdrawn as it had become infructuous. On Monday senior counsel Anand Grover submitted that the curative petition had become infructuous.
