Wankhede remarks: HC quashes order refusing to restrain Malik
The Bombay high court on Monday quashed and set aside the order passed by a single bench of this court refusing to restrain NCP leader Nawab Malik from making comments against the NCB Mumbai zonal director Sameer Wankhede and his family. Now the application filed by NCB officer’s father Dhyandev against the Maharashtra cabinet minister would be heard afresh.
The division bench of Justice Shahrukh Kathawalla and Justice Milind Jadhav quashed and set aside the order of the single bench after Mr Dhyandev and Mr Malik consented that the order passed by Justice Madhav Jamdar be recalled and the interim application filed
in the defamation suit against Mr Malik be heard afresh. Mr Dhyandev is seeking an injunction on the NCP leader so that he doesn’t make allegations against him and his family members before the media and on social media.
When the matter came up for hearing before the division bench on Monday, Mr Dhyandev Wankhede’s counsel Birendra Saraf told the bench that his client had consented to the quashing of the November 22, order.

Tamboly too informed the court that his client will consent to quashing of the order, he will file a detailed reply to the interim application and he will not make public statements or tweets against the Wankhedes until further hearing. He sought that Dhyandev’s application be heard afresh by the single bench.
Following these statements the division bench allowed the minister to file a fresh affidavit in reply to Mr Dhyandev’s interim application by December 9. The court has asked Dhyandev to file his rejoinder to Mr Malik’s affidavit by January 3.
In its order, the division bench has also asked the single bench of Justice Madhav Jamdar to hear the interim application once again.
