Rash driving: Geeta Kapur moves HC for quashing FIR

The petition states that is was ‘merely’ an accident

Bollywood choreographer Geeta Kapur has approached the Bombay High Court seeking quashing of the FIR registered against her for rash driving.

It may be recalled that Kapur was booked by the Versova Police station on March 12, 2015 for under sections 279 (rash driving) and 338 (Causing grievous hurt by act endangering life or personal safety of others) of the Indian Penal Code.

Kapur, who was driving her fourwheeler near Yari Road, Andheri had knocked down a 37-year-old man. The man had sustained a fracture to his right leg ankle, on which he was operated later.

In her petition, Kapur has stated, “During the incident, a speeding car came in front of the petitioner (Kapur) and therefore to avoid collision, an evasive action was needed. The petitioner, who swerved the car to avoid collision was alert enough and did not went near the pavewment to her leftside as many people were sleeping in open.”

The petition states how Kapur took the victim to Kokilaben Ambani hospital and has borne all the expenses of more than Rs seven lakh.

“The petitioner (Kapur) has agreed to to financially help the victim by offering an amount of Rs three lakh towards full and final compensation,” the petition reads. Pointing at the incident, the petition states that is was ‘merely’ an accident.

Kapur has claimed that even the victim has no objection in quashing of the case. She has sought quashing of the FIR on the grounds that she was not under the ‘influence of alcohol’ and neither was she driving the car ‘rashly or negligently’.

A division bench presided over by Justice Abhay Oka and Justice Amjad Sayed is likely to hear the plea in the next week.
