Malad locals not permitted to slaughter goats
In a setback to two Malad residents, the Bombay High Court on Thursday refused to grant permission to slaughter goats in their society premises for the forthcoming Eid-alAdah (Bakri Eid). The HC refused to grant them any relief after considering the resolution passed by the society denying them permission for slaughtering goats.
Asad Shaikh and Abubakar Sangar, residents of Saptarishi Tower Cooperative Housing Society in Malad (west), were aggrieved by the resolution passed by the members of their society against them. They had accordingly approached the HC by filing a writ petition seeking appropriate orders.
A division bench of Justice Ranjit More and Justice Sadhana Jadhav heard their petition. The petitioners contended that slaughtering of goats was part of their religion and was their fundamental right. They claimed that the resolution passed by their society has violated their fundamental right. They even informed the judges that they have obtained the necessary licence to slaughter goats.
The petitioners had accordingly sought permission to allow them to slaughter goats within the premises of the society. They had also sought police protection for themselves.
However, advocate Kishore Patil appearing for the society informed the judges that the petitioners have not challenged the society’s resolution that denied them permission to slaughter goats. He also told the judges that the HC is not the appropriate forum to challenge the resolution as it can be done only in the cooperative court.
After considering the resolution that was passed by a majority of votes of the society’s managing committee, the bench refused to intervene in the issue. However, the judges asked the petitioners to approach the Cooperative Court and seek the reliefs.
