Revenue Tribunal gets addl charge of appellate authority

The state government has given an additional temporary charge of appellate authority to the Maharashtr­a Revenue Tribunal before setting up an appellate authority. This move has been taken in order to enable the builders and home buyers to file complaints against Real Estate regulatory Authority (RERA) rulings.

According to the Section 49 (1) of the RERA act, an interim tribunal must be formed before a RERA appellate tribunal is being establishe­d by the government.

“In the act it is mentioned that a temporary tribunal needs to be in place in order to clear the appeals made by the builders or home buyers,” said a RERA official.

This temporary tribunal will act as a court where builders or home buyers could file an appeal.

The state government has planned to form RERA appellate tribunal by the month of February. This temporary tribunal would help the builders and buyers to approach it in case they are willing to file complaints against the RERA rulings.

Till date, the complaints related to RERA orders were dragged in court which made it difficult for the home buyers.

In November, a consumer body, Mumbai Grahak Panchayat (MGP), had approached Chief Minister Devendra Fadnavis and asked him expedite the process of forming an appellate tribunal.

“The citizens will be able to approach the tribunal from next year onwards in order to get their issues redressed,” said a RERA official.

This temporary tribunal will act as a court where builders or home buyers could file an appeal. The formation of the tribunal is compulsory as per Section 49 (1) of the RERA Act
