550 Mira Road flat owners receive MahaRERA boost

Nearly 550 flat owners of Mira Road project—Tanvi Eminence, finally gets a relief. Recently, MahaRera passed an order asking the promoter (one of the promoters in the project) Dayabhai Sutariya to handover the units by December 2019.

Despite, the on-going dispute of the promoters— Tanvi Constructi­ons private Limited, Dayabhai Sutariya and Bhupat Ravijbhai Lukhi in the Bombay High Court, MahaRera passed an order. “This is a milestone judgement. Despite the court case, MahaRera decided to address the issues faced by the flat owners due to the delay of project,” said Ramesh Prabhu, who represente­d Tanvi Eminence Owners Welfare Associatio­n.

It was argued that the project registrati­on be revoked as per section 7 of RERA and the Associatio­n was ready and willing to take over the completion of the project and appropriat­e the profit. “Due to this, the promoters decided to settle their difference and enter into consent terms with the Associatio­n. The project deadline was also fixed,” added Prabhu.

Prabhu stated, “MahaRera, Chairman, Gautam Chatterjee asked the promoters to come in terms with the flat owners or face cancellati­on of the project. This forced the promoters to set aside the dispute and resolve the issue.”

Adding to it, Kishore Manyal, one of the flat owners said, “Everyone is very happy. For a while now, the flat owners have been waiting for this verdict. I am happy that all the flat owners came

together for this and made it happen.” Manyal revealed that one of the promoters, Sutariya decided to take over the said project by acquiring stakes of other two promoters. This saved the promoters from facing cancellati­on of the project and giving the project to Owners Welfare Associatio­n.

Some level of activity has already started at the site. The promoter will have to give the flat owners the possession letter and occupancy letter by 2019.

“As per the agreement, the promoter will have to update the flat owners every six months,” added Manyal.
