MHADA to take up Patrawala Chawl redevelopment project

Builder fails in adhering to agreement norms

The Maharashtra Housing and Area Development Authority (MHADA) has planned to make an appeal to National Company Law Tribunal (NCLT) in order to take over the redevelopment project of Patrawala Chawl in Goregaon. This comes after a decision taken by National Company Law Tribunal (NCLT) in pending matters against developer Guru Ashish Developers Private Limited. MHADA had also served a notice of termination of the work which was to be completed on February 12.

“We are required to file an affidavit by February 27 as the hearing is scheduled on the said date. The final decision will be taken up by NCLT as the developer had taken a loan of Rs 200 crore from Union Bank and had not repaid it. Due to this, Union Bank had moved to NCLT. After the legal procedures, MHADA will be able to take up the project work,” said a MHADA official.

The project has been in a limbo since 2008 after an agreement was signed with Guri Asish developers. The developer had failed the follow the norms and delayed the project work. Mhada had served a notice period of 30 days to developer to terminate the project work.

The redevelopment project is set to provide houses to at least 672 residents from Patrawala Chawl located at Siddharth Nagar in Goregaon.

The MHADA officials said the developer had failed to follow the rules mentioned in the agreement.

“We signed the agreement with the developer in 2008. The agreement states the deadline for the project as 36 months and the developer had failed to follow the rules listed in the agreement,” said a MHADA official.

MHADA officials also said the developer appointed another consultant for the project work. The developer had also demolished the tenements and gave temporary rehabilitation for the residents.

The agreement also mentioned the requirement of the developer to pay the rent amount to MHADA for rehabilitating the 672 residents.

“The developer had not even paid the rent amount to us. He had also failed to follow the rules of the redevelopment project work and constructing the new buildings within 2.28 lakh square metres,” added the official.
