HC upholds conviction of ‘rapist’ father
No mother would damage prospects of daughter's marriage, rules court

The Bombay High Court recently upheld the 20 years rigorous imprisonment of a man, who was convicted for raping his 11-years-old daughter. The HC while upholding the conviction said no one would file such a complaint at the stake of family's honour.
A single-judge bench of Justice Anant Badar trashed the defence of the man that he was falsely implicated by his daughter in the case as he had scolded his son and wife.
“The incident in question is that of penetrative sexual assault by the father and involves the honour of the family. No mother would register such a case which can even damage the prospects of the marriage of her daughter," Justice Badar ruled.
"The victim has deposed against her own biological father and there is nothing in her statements to suggest even remotely that she has been tutored by someone to falsely implicate her own father that too in such a heinous crime,” Justice
Badar.
“Mere scolding and assaulting her brother by her father, by no stretch of imagination can constitute a reason for false implication of her father in such a serious crime,” Justice Badar further observed.
The bench was seized with an appeal filed by Shridhar Gatir challenging his conviction by Nasik court.
According to prosecution, Gatir had raped his minor daughter when she was alone at her home. The prosecution further accused Gatir of threatening his daughter and his wife of dire consequences, if they report the incident to police.
