Jail authorities’ decision correct as per rules: Court INDRANI’S PLEA REJECTED
A special CBI court that rejected an application by Indrani Mukerjea, the main accused in the Sheena Bora murder case, to be exempted from wearing a green saree in prison that is worn by convicts in prison, has said in its order that the jail authorities have taken the correct decision. “The decision of Byculla jail authorities is correct as per prescribed prison rules...hence the application deserves to be rejected,” special CBI judge Jayendra C Jagdale said in his detailed order made available on Wednesday.
The Byculla jail, where Indrani is lodged since 2015, had submitted before court the prison rules in respect of clothing, bedding, etc. The court found the rules indicated that as a Class II convicted criminal prisoner under sentence of rigorous imprisonment or life imprisonment or death or an unconvicted criminal prisoner (under-trial) accused of murder shall wear clothing prescribed under the rule and bedding supplied free of cost.
“Apparently, the applicant/accused is an under-trial and charged for the offence punishable under section 302 (punishment for murder) of the Indian Penal Code. Obviously, the above mentioned rule is applicable in the case of the applicant/accused,” Judge Jagdale said in his order. She was produced through video-conferencing on 8 December. She had then expressed her grievances that the jail authorities have directed and provided a specific dress code to her.
