De­fence staff held for sex­ual mis­con­duct

He was court-mar­tialled for mis­be­hav­ing with lady cadet at OTA

A phys­io­ther­apy as­sis­tant at the Of­fi­cers Train­ing Academy (OTA) was im­pris­oned after he was con­victed of sex­u­ally as­sault­ing a lady cadet on the OTA premises three years ago.

The of­fender J. Prakash was work­ing as Naik — phys­io­ther­apy as­sis­tant, at OTA. On April 11, 2015, he touched the lady cadet in­ap­pro­pri­ately, on the pre­text of phys­io­ther­apy treat­ment. He as­saulted her again after two days.

Three charges

Fol­low­ing her com­plaint, he was tried be­fore the Dis­trict Court Mar­tial on three charges, in­clud­ing Sec­tion 354 of IPC, which deals with us­ing crim­i­nal force on a woman with in­tent to out­rage mod­esty and for ad­min­is­ter­ing phys­io­ther­apy treat­ment to the lady cadet in the ab­sence of a woman at­ten­dant, con­trary to the stan­dard oper­at­ing pro­ce­dure. The Dis­trict Court Mar­tial dis­missed Prakash from ser­vice and sen­tenced him to rig­or­ous im­pris­on­ment for two years.

The sen­tence was con­firmed by Lieu­tenant Gen­eral S.T. Upasani, Gen­eral Of­fi­cer Com­mand­ing, South­ern Area, as re­quired by law. The Army unit sent Prakash to the cus­tody of Nan­dambakkam In­spec­tor S. Si­vaku­mar with a war­rant to ex­e­cute the sen­tence. He took Prakash into cus­tody.
