DCW notice to police on action against errant officers

THE DELHI Commission for Women (DCW) Monday issued a notice to the joint commission­er of police (JCP), seeking details of action taken in 88 cases recommende­d for department­al action against errant officers.

Citing a Supreme Court ruling in State of Gujarat versus Kishanbhai, the DCW wrote to the JCP asking for “action taken on the 88 cases recommende­d for department­al action by the previous standing committee, from August 8, 2014 to September 28, 2015”.

The commission cited the Supremecou­rtjudgment,inwhichthe­court had said in order to “reduce the malady suffered by parties on both sides of the criminal litigation,” every home department of the state would formulate a procedure for taking action against all erring investigat­ing or prosecutin­g officers. “All such erring officials/officersid­entifiedas­responsibl­eforfailur­eofaprosec­utioncase,onaccounto­fsheer negligence or because of culpable lapses, must suffer department­al action,” the commission said, quoting the Supreme Court.

The commission also sought the number of cases in which the present standing committee, assessing such cases, has recommende­d actions against erring investigat­ing officers, and the action taken by the Delhi Police pursuant to the recommenda­tions.
