Use of prohibited snakes in video: Gurgaon court orders FIR against Youtuber Elvish Yadav
A GURGAON court on Thursday ordered an FIR to be registered against Bigg Boss OTT 2 winner and Youtuber Elvish Yadav in connection with alleged use of prohibited snakes in a video.
The court of Additional Chief Judicial Magistrate Manoj Kumar Rana said that the complaint against Yadav can only be ascertained by way of a fair, proper, thorough and impartial probe by police, “which shall not only save the valuable time of the Court, but also be instrumental in separating the chaff from the grains”.
The plea by the complainant, who works with People for Animals, stated that ya dav and 50 other people were seen using various snakes, which are prohibited as per the virtue of the Wildlife (Protection) Act, 1972. The plea further alleged that a video in this regard was shot in a mall in Gurgaon, adding, Yadav along with unknown persons indulged in other illegal activities as well.
Filing the plea under CRPC 156(3), the complainant referred to a case, Sakiri Vasu vs State of UP (AIR) 2008 SC 907, wherein it was held by the Supreme Court that, “If a person has a grievance that the police station is not registering his fir under section 154 crpc, then he can approach the Superintendent of Police under Section 154(3) crpc by an application in writing .” The judgment said even if the plea does not yield any satisfactory result, it is open to the aggrieved person to file a plea under Section 156 (3) before the learned Magistrate concerned.”
In such a case, the Magistrate can direct the FIR to be registered..., according to the judgment. The magistrate directed the SHO of Badshahpur police station to register an FIR under the relevant provisions of law.
