AAP LEADER WITHDRAWS PETITION IN SUPREME COURT AS MCD MAYOR POLLS SET TO TAKE PLACE ON 6 FEB

The petition before the Supreme Court of India has been filed by Aam Aadmi Party’s mayor candidate Dr Shelly Oberoi, wherein demanding timely conduct of Delhi mayoral elections has been withdrawn on the ground that the elections are going to take place on coming Monday i.e., 06.02.2023.

The bench comprising of Chief Justice DY Chandrachu­d and Justice PS Narasimha was hearing the present plea.

At the Outset, it has been noticed by the CJI DY Chandrachu­d that the mayoral elections were now happening on 6th February and the purpose of the petition had now been met with. It has been highlighte­d by the Senior Advocate AM Singhvi that there being two things, firstly, that the said elections happened very late. Secondly, the votes who being in the list of the poll cannot be Aldermen.

A resolution has been passed by the Delhi Assembly moved by AAP MLA Saurabh Bhardwaj, wherin the direction has been seek by the said court to the MCD Commission­er for ensuring that the nominated members (Aldermen) are not being allowed to vote in the House during Mayoral polls, as it is being stated in the Constituti­on.

It has also been remarked by CJI DY Chandrachu­d that this being not the what the petition was about. The plea is all about timely conduct of elections and if this court is adjudge on this, then we’ll have to stay the proceeding­s again and you don’t want to stay also. Accordingl­y, it has also been suggested by the bench that Dr Singhvi to withdraw the petition on the ground that election was taking place. The liberty has also been granted by the bench to come back.

Therefore, the Delhi mayor election was to be taken place on 24.01.2023 (for the second time in January). The said elections were being stalled wherein it is owed to the House being adjourned indefinite­ly by the Lg-appointed presiding officer following ruckus by some councilors. The court also adjourned the first meeting of the newly elected House of the Municipal Corporatio­n of Delhi (MCD) on January 6 owing to ruckus between AAP and BJP members.
