Plea dismissed seeking guidelines to curb violence during religious processions
The Supreme Court in the case Vishal Tiwari v. UOI And Ors observed and has dismissed and has withdrawn a plea moved seeking all-india guidelines to curb clashes or violence during religious processions.
The bench comprising of Justice Sanjiv Khanna and Justice Aravind Kumar in the case observed and has expressed disinclination to entertain the matter, wherein the petitioner in the case decided to withdraw the plea.
The bench orally told the petitioner that, let us not make this such a big issue. This court cannot get into legislation. You can withdraw the same
However, the petitioner, Advocate Vishal Tiwari, appearing as partyin-person brought to notice the unfortunate trend of violence year after year during the happening of religious processions.
In the said case, the PIL was moved by referring to the violence which erupted during the religious processions which was being held during the recent Ram Navami celebrations.
It has also been claimed in the plea filed that despite of the occurrence of similar incidents every year, thus, the Respondent authorities have never taken any action and the law enforcement is not strict.
The petitioner in the plea filed stated that the present situation which is prevailing at various places of the country which being due to political and communal tensions orchestrated by unregulated powers of the society with no action from the government which pertains ito prevention of such incident. Last year, the Ram Navami celebrations in India saw the similar fate witnessed similar repercussions and violence all over the country in this year, thus, the festival was marked by violence across several states.
The bench headed by CJI DY Chandrachud in the month of December, 2022 in the case refused to entertain a similar petition filed by the NGO ‘Citizens for Justice and Peace’, wherein seeking guidelines to regulate religious processions. Therefore, the plea moved by CJP to the instances of violence occurred during the Ram Navami and Hanuman Jayanti processions held during April 2022.
