Gen­pact case ar­rests stayed till Mar 6

Greater Noida: The Al­la­habad high court has is­sued an in­terim stay on the ar­rest of Gen­pact em­ploy­ees, who have been ac­cused of abet­ting the sui­cide of as­sis­tant vice-pres­i­dent Swa­roop Raj last month.

On Fri­day, a divi­sion bench of Jus­tices Manoj Mishra and Vivek Singh fixed the next date of hear­ing on March 6 and di­rected po­lice to ei­ther sub­mit the chargesheet or record the state­ments of the ac­cused dur­ing the pe- riod. Swa­roop, who was sus­pended from the com­pany on De­cem­ber 18 fol­low­ing com­plaints of sex­ual harass­ment against him, had com­mit­ted sui­cide that day it­self.

Based on a com­plaint filed by Swa­roop’s wife Kriti, a case of abet­ment to sui­cide was filed against the two com­plainants, the Gen­pact man­age­ment and mem­bers of the com­pany’s in­ter­nal com­plaints com­mit­tee.

Gen­pact had filed a pe­ti­tion against any ar­rest in the case, claim­ing there was “no in­sti­ga­tion on the com­pany”.

Katyayni, the lawyer rep­re­sent­ing Swa­roop’s fam­ily, said the high court had di­rected po­lice against tak­ing any co­er­cive ac­tion till March 6. “Dur­ing this pe­riod, the po­lice will ei­ther have to sub­mit the chargesheet or at least record the state­ments of the ac­cused,” Katyayni said.

Muneesh Chauhan, the SHO of Su­ra­jpur po­lice sta­tion and the in­ves­ti­gat­ing of­fi­cer in the case, said he was yet to re­ceive a copy of the court or­der.
