MLA gets interim relief in civic official’s assault case
New Delhi: Model Town MLA Akhileshpati Tripathi was on Wednesday granted interim protection from arrest in an alleged case of assault of a municipal corporation official on September 5.
Special judge Ajay Kumar Kuhar said, “Let notice of the application be issued to the concerned SHO returnable (next date of hearing) on September 13, 2019. Till then, no coercive action will be taken against Tripathi.”
Tripathi, in his anticipatory bail plea, said an FIR against him was registered under IPC Sections 186 (obstructing public servant in discharge of public function), 353 (assault or criminal force to deter public servant from discharge of his duty, 332 (voluntarily causing hurt to deter public servant from his duty) and 34 (common intention).
His plea claimed that the case against him was fabricated and false. “To put a veil on their brazen ineptness and illegal omission to perform duties towards the residents of Model Town, civic officials have haphazardly unfurled false and fabricated allegations.”
The civic inspector, Ravinder Gupta, in his complaint said he was carrying out cleaning work at Lal Bagh Delhi’s Azadpur on September 5 when the MLA arrived with his supporters and tried to obstruct the work. When he objected, Tripathi abused and thrashed him, Gupta added. Police were alerted about the incident at 1.30pm, following which a team reached the spot and shifted Gupta to BJRM hospital in Jahangirpuri.
