MLA gets in­terim relief in civic of­fi­cial’s as­sault case

New Delhi: Model Town MLA Akhilesh­pati Tri­pathi was on Wed­nes­day granted in­terim pro­tec­tion from ar­rest in an alleged case of as­sault of a mu­nic­i­pal cor­po­ra­tion of­fi­cial on Septem­ber 5.

Spe­cial judge Ajay Ku­mar Kuhar said, “Let no­tice of the ap­pli­ca­tion be is­sued to the con­cerned SHO re­turn­able (next date of hear­ing) on Septem­ber 13, 2019. Till then, no co­er­cive ac­tion will be taken against Tri­pathi.”

Tri­pathi, in his an­tic­i­pa­tory bail plea, said an FIR against him was regis­tered un­der IPC Sec­tions 186 (obstructin­g pub­lic ser­vant in dis­charge of pub­lic func­tion), 353 (as­sault or crim­i­nal force to de­ter pub­lic ser­vant from dis­charge of his duty, 332 (vol­un­tar­ily caus­ing hurt to de­ter pub­lic ser­vant from his duty) and 34 (com­mon in­ten­tion).

His plea claimed that the case against him was fab­ri­cated and false. “To put a veil on their brazen in­ept­ness and il­le­gal omis­sion to per­form du­ties to­wards the res­i­dents of Model Town, civic of­fi­cials have hap­haz­ardly un­furled false and fab­ri­cated al­le­ga­tions.”

The civic in­spec­tor, Ravin­der Gupta, in his com­plaint said he was car­ry­ing out clean­ing work at Lal Bagh Delhi’s Azad­pur on Septem­ber 5 when the MLA ar­rived with his sup­port­ers and tried to ob­struct the work. When he ob­jected, Tri­pathi abused and thrashed him, Gupta added. Po­lice were alerted about the in­ci­dent at 1.30pm, fol­low­ing which a team reached the spot and shifted Gupta to BJRM hos­pi­tal in Ja­hangir­puri.
