COURT OF APPEAL RULES SUSPENDED SENTENCE WAS ‘UNDULY LENIENT’

Mr Justice Birmingham said the Court of Appeal was obliged to sentence as of that day’s date. In doing so, the court considered that it was sentencing a now 71-year-old man.

In those circumstan­ces the court kept the period required to be served at a minimum.

The court also had regard to up to date medical informatio­n which was taken into account.

Mr Justice Birmingham, who sat with Mr Justice Alan Mahon and Mr Justice John Edwards, said the court would vary the sentence and would impose a new three-year sentence with all but four months suspended.

Dignam noted the judgement with a nod of his head. He was not required to go into custody that afternoon, as the court put a stay on that for one week until Monday last, March 27.
