Held mo­bile while driv­ing

A PROS­E­CU­TION for hold­ing a mo­bile phone while driv­ing was re­sisted all the way by John Reidy (31), Camolin Park when he ap­peared at the Dis­trict Court in Wex­ford, to no avail.

Garda David Kelle­her’s ev­i­dence was that he saw a phone held to the de­fen­dant’s right ear in Oyle­gate on Fe­bru­ary 5.

Reidy’s ver­sion of events was that he was in pain and hold­ing his hand to his head af­ter sus­tain­ing a gash an hour ear­lier as he was hit by a steel bar.

Judge Ger­ard Haughton ac­cepted the garda’s ev­i­dence, im­pos­ing a con­vic­tion with a €150 fine.
