Girl who broke collarbone at GAA fun day awarded €47k
A GIRL who broke her collarbone when she was pushed by other children as she played inside a large inflatable ball has been awarded €47,000 damages.
Ayesha Imran, who was 11 when the accident happened in September 2013, had been attending a fun day at Lucan Sarsfield GAA Club, organised by Bacstroke Entertainment Ltd of Stillorgan Business Park.
‘She went into an inflatable plastic ball, which you rolled in around a course,’ her counsel, Eoin McGonigal SC told the High Court. ‘Some other young people started interfering with her. On the first occasion her parents made a complaint but nothing was done. It happened a second time, and this caused her to suffer a fracture to her right clavicle.’
Ayesha, from Liffey Valley Park, Lucan, Co. Dublin, was referred to Crumlin Hospital for treatment from a specialist orthopaedic team.
An X-ray revealed a severely displaced fracture of her collar bone, and she had to wear a sling for three months and attend physiotherapy.
She has since made a good recovery, Mr McGonigal said.
It had been claimed that the defendants failed to supervise the activity or to prevent other children from pushing the ball and had failed to employ sufficient numbers of staff. He said liability had been admitted in the case, which was taken against both the event organisers and the GAA club.
An offer had been made to settle the case for €47,000, which Ayesha, now 15, and her parents were happy to accept, he added.
Judge Kevin Cross said he would approve the settlement.
