BY RNEWALLACE LLP has just announced the appointment of Louise Carley as partner in the firm’s Health and Social Care Team.

Louise has been advising on child care and healthcare law for 11 years. A skilled litigator, she has extensive experience in the areas of complex child care and healthcare litigation, child mental health law, judicial review, adoption law, European law, public law, constitutional Law, court advocacy and alternative dispute resolution.

Louise has particular expertise advising on cross-border child protection, and complex cases involving adoption, surrogacy, step-parent or same sex adoption.

She has brought a number of applications under Article 15 of the Brussels II Regulation to transfer proceedings to different jurisdictions within Europe.

In 2018, Louise successfully defended a very complex judicial review of one such Article 15 application.

She has also brought the first application for intended Wardship on behalf of Tusla/child and Family Agency for a minor in state care due to turn 18 years of age in need of interim protection to the High Court. This developed the process and precedent for subsequent cases.

Commenting on the announcement, Managing Partner Feargal Brennan said: “For over 30 years, Byrnewallace LLP has been at the forefront in the development of healthcare law, including child protection, social care and mental health law, in Ireland.

“This experience has given us the extensive knowledge and expertise required to deal with a wide range of complex issues affecting the healthcare sector.

“We pride ourselves in providing immediate, expert and practical advice, and are committed to achieving results for our clients.

“Louise’s appointment is testament to the excellent work carried out by Louise and her colleagues in our Health and Social Care Team, and by all our lawyers across the firm who advise clients in this increasingly complex and specialist area.”

Sinead Kearney, Head of Health and Social Care said, “Child care law is an area of the law that is constantly evolving and developing; it is complex, challenging and nuanced.

“Louise is a recognised expert in this field,” she added.
