THE garda told he was to be sacked over his porn video with this cop lover has won a final legal fight against dismissal, it has emerged.

The Star has learned that the officer has won a High Court case that bar s Garda Commission­er Drew Harris from sacking him over his video with Carla Gabberlove­r — also known as Carla4Gard­a — more than four years ago.

The decision by a High Court judge means it is the end of the road for Mr Harris’ repeated efforts to have the officer dismissed sed for the April 2017 17 video of the steamy y romp that led to a major internal disciplina­ry probe.

“He has finally won his case,” a source told The

Star last night.

“The

Commission­er lost t in court and that is the end of it.”

Ms Gabberlove­r last night told The Star r she was happy the garda d had won his legal battle. “I’m delighted for him,” she said.

Sources say the officer took legal act ion af ter the Commission­er refused to accept the findings of the internal probe — that stopped short of sacking the young garda.

Instead, Mr Harris said the officer had brought the force into disrepute — and decided he should lose his job.

Now, sources have confirmed, a

High Court judge has ruled that the Commission­er should not have overruled the original decision — and ordered him not to sack the officer.

The officer has been in legal limbo ever since an investigat­ion into the video that was put online in early 2017.

Although he hid his face, he was q quickly y identified after the clip s showed an official Garda car.

Gardai Ga were able to identify iden the unit that used us the car and then th tracked the garda g down.

He was then s suspended, before being was reinstated in mid 2 2018 — but was t told he was facing a an internal discipl plinary process. That board of inquiry inqu ruled that the officer should be hit with a fine of three weeks’ k pay, but also decided he should keep his job.

The Commission­er, however, took a different view and asked the officer to resign.

The young officer then appealed to another internal Garda disciplina­ry body — which found in his favour. Despite that, the Commission­er insisted he should be sacked and the garda then went to the High Court to try to keep his job. Sources have now confirmed he has now won his case — and the Commission­er is not allowed to dismiss him.

A Garda spokesman declined to comment last night.

He said: “An Garda Síochána does not comment on internal disciplina­ry matters.”

Pals of the garda have told The Star he is delighted to have won his case.

But it’s understood other serving and retired officers in the area where he works are unhappy at the decision.

One source said: “A lot of members were unhappy when this thing blew up and were glad the Commission­er wanted him out.”

The officer caused a massive scandal when he was filmed having sex with Ms Gabberlove­r.

The scene went viral online and he was quickly identified.

Escapades

In the clip, the officer was seen wearing a Garda jacket before using force regulation handcuffs on the woman — and then appearing to have sex with her on the bonnet of an official car.

The video begins with the woman reading The Star’s story of her previous sex escapades.

She then addresses the man with a “yes garda?”, before he replies: “You’ve been a very naughty girl.”

The man, wearing a distinctiv­e blue garda jacket, then handcuffs the woman, stating: “I must caution you now.”

The woman then proceeds to perform a sex act on the man, with the side of the marked garda car clearly in view.

At one stage he tells the woman: “I think you should be punished more. Get over that bonnet.”

The pair then have sex on top of the garda car.
