Abduct rap pair in court

A FATHER- OF-THREE who submitted false documents in order to obtain a mortgage for his family home has received a fully suspended sentence.

The deception by Gary Hurley (38) only came to light when the mortgage entered into arrears.

Dublin Circuit Criminal Court heard that the bank have restructur­ed the loan and are allowing him to continue repaying the mortgage.

Hurley, of Cherrywood Drive, Clondalkin, pleaded guilty to deception and use of a false instrument at KBC Bank, Sandwith Street Upper, Dublin 2 on October 20, 2017.

Passing sentence, Judge Melanie Greally said the evidence was that Hurley was suffering from depression and “general desperatio­n” at the time of the offending.

Judge Greally said “one can only infer the bank are reasonably well- disposed” to the accused and are willing to keep taking his money to discharge the mortgage. She said she did not see any real purpose at this time in incarcerat­ing him.

Judge Melanie Greally sentenced Hurley to three years’ imprisonme­nt, but suspended the sentence in its entirety on strict conditions.

A MOTHER and father accused of abducting their child have been released on bail with strict conditions and must remain drug and alcohol-free.

They appeared at Dublin District Court yesterday. Gardai objected to bail due to the seriousnes­s of the case.

Gardai said the pair, aged in their 30s, had been caught red-handed this week when a family member saw them leaving the scene earlier this week. They had an access arrangemen­t prior to the alleged kidnapping.

They are to appear again in court on November 11.
